Defendant having moved for permission to proceed as a poor person on the appeal taken from a judgment of the Supreme Court, Monroe County rendered June 15, 2010, and for assignment of counsel,

Now, upon reading and filing the affidavit of Christine L. Coppeta sworn to July 6, 2010, the notice of motion with proof of due service thereof, the statement of Loretta S. Courtney, Esq., dated July 15, 2010 and the statement of Brett C. Granville, Esq. dated August 20, 2010, due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied without prejudice to renewal upon a more detailed showing of facts demonstrating that defendant is indigent (see 22 NYCRR 1000.14 [a][1]), and

It is further ORDERED that the notice of appeal timely served on June 29, 2010 and timely filed in the Monroe County Clerk's Office on June 28, 2010, which contains an inaccurate indictment number, shall be treated as valid as to the judgment rendered under indictment number 2009-0899, pursuant to CPL 460.10(6).
