Appellant having moved to consolidate the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Monroe on April 30, 2010, and August 5, 2010, and to extend by 60 days the time to perfect the appeal from the order entered April 30, 2010,
Now, upon reading and filing the affirmation of Warren B. Rosenbaum, Esq. dated August 20, 2010, the notice of motion with proof of service thereof, the statement of Gregory J. Mascitti, Esq. dated September 9, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to consolidate the appeals is granted and the appeals from the orders entered April 30, 2010, and August 5, 2010, are hereby consolidated for the purposes of perfecting and arguing the appeals, and
It is further ORDERED that the motion insofar as it seeks a 60-day extension of time to perfect the appeal from the order entered April 30, 2010, is dismissed as premature (see 22 NYCRR 1000.13 [f]).
