It is Ordered that the motion is granted only to the extent of directing the appellant to perfect its appeal by correcting its records by October 12, 2010, in order to be noticed for the December 2010 Term. In the event of appellant's failure to comply with the foregoing conditions, landlord may move on five days notice to dismiss the appeal. The parties have agreed to the payment of use and occupancy at $200- per month from March to September 2010.
