DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to reargue his prior motion to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Nassau County, rendered October 10, 2007, and for the assignment of new counsel which was determined by decision and order on motion dated September 30, 2009.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied without prejudice to seeking leave to file a supplemental pro se brief after assigned counsel files a brief on his behalf.
