| ORDER ON APPLICATION |
Application by the respondent Data Plus Management, LLC pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Nassau County, dated June 18, 2009.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted to the extent that the time of the respondent Data Plus Management, LLC to serve and file a brief is enlarged until October 12, 2010, and the brief of the respondent Data Plus Management, LLC must be served and filed on or before that date; and the application is otherwise denied; and it is further,
ORDERED that the reply brief in response to the brief of the respondent Data Plus Management, if any, shall be served and filed on or before November 12, 2010.
