On the court's own motion, it is
ORDERED that its order on application dated October 1, 2010, in the above-entitled matter, which granted an application by the appellant , on an appeal from an order and judgment (one paper) of the Supreme Court, Dutchess County, dated January 13, 2010, is amended by deleting from the second paragraph the words "no papers having been filed in opposition or in relation thereto" and substituting therefor "the papers filed in opposition thereto."
