It is Ordered that the motion by appellant is granted to the extent of staying the trial pending determination of the appeal on condition that the appeal is perfected by no later than the January 2011 term - the filing deadline is November 9, 2010. If not perfected by November 9, 2010, then the motion for a stay is denied and the trial may proceed.
