DECISION & ORDER ON MOTION

Motion by appellant for a stay pending the determination of an appeal from an order of the Civil Court of the City of New York, Kings County, entered August 31, 2010, which ordered that respondent be restored to possession of the premises on condition that she pay the sum of $4,557.89 to appellant.
Upon the papers filed in support of the motion and the papers filed in opposition
thereto, it is,
ORDERED that the motion is denied; and it is further,
ORDERED that respondent shall be restored to possession of the premises forthwith on condition that she comply with the order of the Civil Court within 10 days of this decision and order by paying appellant the sum of $4,557.89.
