ORDERED that the motion for permission to proceed as a poor person and to grant petition upon default is denied, without costs. Respondent's answer shall be filed with the Clerk of the Court of original instance and served on or before November 8, 2010, and it is further

ORDERED that the cross motion to dismiss the proceeding is denied, without costs, and without prejudice to the issues involved being raised upon the argument of the proceeding.
