ORDERED that the order on application of this court dated September 30, 2010, in the above-entitled appeal, which granted the appellant-respondent's application to enlarge the time to perfect an appeal and cross appeal from an order of the Supreme Court, Kings County, dated March 5, 2010, is amended by deleting from the second paragraph thereof the words "and no papers having been filed in opposition or relation thereto", and substituting therefor the words "and the papers filed in opposition thereto".
