Respondents having moved for an extension of time to file and serve a brief on the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Monroe on September 11, 2009,

Now, upon reading and filing the affirmation of Michele Di Gaetano, Esq. dated September 17, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered August 24, 2010, is hereby amended by deleting the date September 23, 2010, and inserting in its place the date October 25, 2010, and

It is further ORDERED that the second ordering paragraph of the order of this Court entered August 24, 2010, is hereby amended by deleting the date October 8, 2010, and inserting in its place the date November 9, 2010.
