DECISION & ORDER ON MOTION
| North Shore University Hospital at Manhasset, Respondent, v Kathleen DeMartino, Individually and as Parent and/or Legal Guardian of Sabrina DeMartino, Appellant. |
Motion by appellant for a stay of enforcement of a judgment of the District Court of Nassau County, First District, entered March 22, 2002, pending the determination of an appeal from an order of the same court entered June 2, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,
ORDERED that the motion is granted on condition that within 10 days of the date of this decision and order appellant deposit with the court below the sum of $15,308.93 and upon the further condition that the appeal be perfected by December 3, 2010; and it is further,
ORDERED that appellant shall file with this court proof of the deposit within one business day after the deposit is made; and it is further,
ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
