DECISION & ORDER ON MOTION

Motion by the respondent pro se on an appeal from an order of the Family Court, Kings County, dated October 26, 2009, for poor person relief and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied, with leave to renew on or before November 12, 2010, upon proper papers, including the appellant's affidavit setting forth the amount and source of counsel fees paid to retained counsel; and it is further,

ORDERED that the respondent's time to serve and file a brief on the appeal is enlarged until December 6, 2010, and the respondent's brief must be served and filed on or before that date.
