DECISION & ORDER ON MOTION
| Alfonso Bahamonde, Respondent, v Jonathan Grabel and Patricia Grabel, Appellants. |
Motion by appellants to stay enforcement of a judgment of the Justice Court of the Village of Scarsdale, Westchester County, entered June 7, 2010, pending the determination of an appeal therefrom.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and enforcement of the judgment is stayed on condition that within 14 days from the date of this decision and order appellants deposit the amount of the judgment into the Justice Court and upon the further condition that the appeal be perfected by December 3, 2010; and it is further,
ORDERED that appellants shall file with this court proof of the deposit within one business day after making such deposit; and it is further,
ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
