ORDERED that the cross motion for an extension of time to serve the notice of appeal upon respondent is granted, without costs, and the notice of appeal is deemed timely served, and it is further

ORDERED that the cross motion to dismiss the appeal is denied, without costs, and it is further

ORDERED that the motion for an extension of time to perfect the appeal is granted, without costs, and the time to perfect the appeal is extended to November 10, 2010. It is noted that in order to obtain any additional extension of time to perfect the appeal, appellant, pursuant to § 800.12 of this Court's Rules of Practice, must make a motion supported by an affidavit setting forth both a reasonable excuse for the delay and facts showing merit to the appeal.
