DECISION & ORDER ON APPLICATION

In the Matter of Richard Brown, etc., petitioner,

v Joel L. Blumenfeld, et al., respondents.

Application by the respondent Joel L. Blumenfeld pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file an answer in a proceeding pursuant to CPLR article 78 for a writ of prohibition, to enlarge the time for the petitioner to serve and file his reply, and to adjourn the return date of the petition.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and the respondent Joel L. Blumenfeld's time to serve and file an answer is enlarged until November 19, 2010, and the answer of the respondent Joel L. Blumenfeld must be served and filed on or before that date; and it is further,

ORDERED that the petitioner's reply, if any, shall be served and filed on or before December 15, 2010; and it is further,

ORDERED that the return date of the petition is adjourned to December 17, 2010.
