DECISION & ORDER ON MOTION

Appeal by Ernie Driggers from an order of the Family Court, Suffolk County, dated November 30, 2009. By decision and order on motion of this court dated July 26, 2010, the appellant's counsel was relieved and the appellant's time to perfect the appeal was enlarged until September 9, 2010. The appellant has not perfected the appeal.

Now, on the court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect the appeal in accordance with the rules (22 NYCRR 670.4[a][2]) and order of this court dated July 26, 2010.
