| DECISION & ORDER ON MOTION FOR REINSTATEMENT |
Motion by the respondent for reinstatement to the Bar as an attorney and counselor-at-law. The respondent was admitted to the Bar at term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 29, 1981, under the name Ray Elliot Shain. By opinion and order of this Court dated May 19, 2003, the respondent was disbarred based on his conviction of a felony and his name was stricken from the roll of attorneys and counselors-at-law, effective immediately. By decision and order on motion of this Court dated June 11, 2009, the respondent's application for reinstatement was denied as premature.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's fitness to practice law.
