Defendant having moved for permission to proceed as a poor person on the appeal taken from an order of the Erie County Court, dated August 20, 2010, and for other relief,

Now, upon reading and filing the affidavits of Brenda Haynes sworn to September 7, 2010, the notice of motion with proof of due service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.

MEMORANDUM: Erie County Court was the intermediate appellate court for the People's appeal from an order of Buffalo City Court (CPL 450.60[3]). In order to obtain any further review of the County Court order, defendant must make an application for leave to appeal to the Court of Appeals before a judge from that court (CPL 460.20 [2][b]; 460.10 [5]). Defendant is not entitled to any relief pursuant to CPL 460.50.
