Motion by appellant, in essence, for leave to reargue his prior motion to vacate the dismissal of his appeal from an order of the District Court of Nassau County, First District, entered June 12, 2008, which was denied by decision and order of this court dated May 26, 2010, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court dated May 26, 2010.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,
ORDERED that the motion is denied.
