The People of the State of New York, Respondent, v Wesley E. Martin, Appellant.

Motion by appellant for an enlargement of time to perfect an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered December 3, 2009, and for a stay pursuant to CPL 460.50.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by December 3, 2010; and it is further,

ORDERED that the branch of the motion seeking a stay is denied.
