DECISION & ORDER ON MOTION

Navy Yard Housing Development FC, Inc., Respondent, v The Estate of Thelma Williams, Tenant, John Doe and Jane Doe, Undertenants, and Terry Clark, Appellant.

Motion by appellant to reinstate and continue a stay contained in an order of this court dated February 4, 2010 pending the determination of an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered December 1, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is,

ORDERED that the motion by appellant to reinstate and continue the stay contained in the order of this court dated February 4, 2010 is granted on condition that appellant perfect the appeal by November 5, 2010. Appellant shall continue to comply with the other conditions contained in the order of this court dated February 4, 2010; and it is further,

ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
