An appeal having been taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on January 10, 2010, and the attorney for the children having moved for an extension of time within which to file and serve his brief,
Now, upon reading and filing the affidavit of Kenneth W. Gibbons, Esq., sworn to October 8, 2010, the notice of motion with proof of service thereof, the statement of Charles J. Greenberg, Esq., dated October 15, 2010, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted on condition that the attorney for the children submit ten copies of his brief to the Court, together with proof of service, on or before November 8, 2010, and the Clerk is directed to accept said briefs for filing.
