DECISION & ORDER ON MOTION

Appeal by Miguel A. Ortega from an order of the Family Court, Suffolk County, dated April 19, 2010. By decision and order on motion of this Court dated September 10, 2010, the appellant's time to perfect the appeal was enlarged until October 13, 2010. The appellant has not perfected the appeal.

On the court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to perfect the appeal in accordance with the order dated September 10, 2010 (see 22 NYCRR 670.4).
