| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated July 8, 2009, and to amend a decision and order on motion of this Court dated July 12, 2010, in the above-entitled matter to reflect the proper Supreme Court, Kings County, Index Number.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the appellant's time to perfect the appeal is enlarged until December 6, 2010, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,
ORDERED that no further enlargement of time shall be granted; and it is further,
ORDERED that the decision and order on motion dated July 12, 2010, in the above-entitled matter, is amended by deleting from the caption thereof the Supreme Court, Kings County, Index No. "30972/04" and substituting therefor the Supreme Court, Kings County, Index No. "590/09."
