ORDERED that its order on application dated October 28, 2010, in the above-entitled case is recalled and vacated, and the following the order on application is substituted therefor:

Application by the respondent Department of Housing Preservation and Development pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief in a proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Kings County, dated October 20, 2009.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted and the time of the respondent Department of Housing Preservation and Development to serve and file a brief is enlarged until November 29, 2010, and the brief of the respondent Department of Housing Preservation and Development must be served and filed on or before that date.
