It is Ordered that the motion to dismiss and vacate the stay is denied. By order of this Court, dated October 12, 2010, the landlord-appellant's time to perfect the appeal in the companion case was extended to the December 2010 term. In the event the appellant fails to comply with the foregoing condition, the respondents may move on five days' notice for an order vacating the stay of the release of funds held by the Sheriff of New York County and dismissing the appeal.
