The People of the State of New York, Respondent, v Michael O'Connor, Appellant.

Motion by respondent to strike an addendum to the appellant's brief (exhibit D) on an appeal from two judgments of the City Court of Yonkers, Westchester County, rendered December 9, 2009, and, in effect, for an enlargement of time to serve and file a respondent's brief.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the branch of respondent's motion seeking to strike the addendum to the appellant's brief is granted; and it is further,

ORDERED that the branch of the motion seeking , in effect, an enlargement of time to serve and file a respondent's brief is denied as academic as the respondent's brief has already been submitted.
