It is ordered that the motion is granted to the extent of permitting the defendant to file an untimely notice of appeal. The Criminal Court Appeals Clerk is directed to file a notice of appeal on behalf of the defendant. That branch of the motion seeking permission to appeal as a poor person and the assignment of counsel is denied without prejudice to renew upon completion of an affidavit pursuant to CPLR § 1101. The Clerk's office is directed to provide an affidavit form to the defendant.
