| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from a judgment of the County Court, Rockland County, rendered August 30, 2007, for leave to reargue his prior motion to enlarge the judgment roll to include the minutes of certain proceedings to aid in the preparation of a supplemental pro se brief, which was determined by decision and order on motion dated March 1, 2010, and, in effect, to enlarge the time to serve and file the supplemental pro se brief. Separate motion by the appellant pro se to relieve assigned counsel and assign new counsel. Separate motion by the respondent, in effect, to vacate a decision and order on motion dated July 14, 2009, which granted the appellant's motion for leave to file a supplemental pro se brief, and to deny that motion.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the appellant's motion which is for leave to reargue the appellant's prior motion to enlarge the judgment roll is denied; and it is further,
ORDERED that the branch of the appellant's motion which is, in effect, to enlarge the time to serve and file the supplemental pro se brief is granted, and the appellant's supplemental brief shall be served and filed on or before January 14, 2010; and it is further,
ORDERED that no further enlargement of time shall be granted; and it is further,
ORDERED that the appellant shall file nine copies of the supplemental brief and serve one copy on the District Attorney; and it is further,
ORDERED that the appellant's motion to relieve assigned counsel and assign new counsel is denied; and it is further,
ORDERED that the respondent's motion, in effect, to vacate a decision and order on motion dated July 14, 2009, which granted the appellant's motion for leave to file a supplemental pro se brief, and to deny that motion is denied.
