| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to enlarge the time to serve and file a reply brief on an appeal from an order of the Supreme Court, Kings County, dated January 22, 2009, and to amend the decision and order on motion of this Court dated September 13, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to enlarge the time to serve and file a reply brief is granted, and the reply brief shall be served and filed on or before December 6, 2010; and it is further,
ORDERED that the branch of the motion which is to amend the decision and order on motion of this Court dated September 13, 2010, is granted, and the decision and order on motion of this Court dated September 13, 2010, is amended (1) by deleting from the caption the Docket No. 2009-04744, and (2) by deleting from the first paragraph thereof the words "on appeals from two orders of the Supreme Court, Kings County, both dated January 22, 2009" and substituting therefor the words "on an appeal from an order of the Supreme Court, Kings County, dated January 22, 2009"; and it is further,
ORDERED that the motion is otherwise denied.
