Now, upon reading and filing the affidavit of Christopher E. Buckey, Esq. sworn to October 18, 2010, and the notice of motion with proof of service thereof, the affirmation of Victor Paladino, Esq. dated October 27, 2010, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and the appeal is dismissed without further order unless the appeal is perfected on or before January 11, 2011.
