| DECISION & ORDER ON MOTION |
Motion by NAPCO Holding LLC, for leave to appeal to this Court from an order of the Supreme Court, Queens County, dated November 4, 2010, and to enjoin the plaintiff, among others, from commencing any litigation concerning the subject premises against it or its agents, and to stay all proceedings in a certain action pending in the Civil Court of the City of New York, Kings County, Small Claims Part, under Index No. 5038/10.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
