| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Kings County, dated March 27, 2009. The appeal previously was held in abeyance due to the filing of a petition pursuant to Chapter 7 of Title 11 of the United States Code, in the United States Bankruptcy Court for the Eastern District of New York (see In re: Mark H. Kaplan, a/k/a Chaim Kaplan, Case No. 1-09-48395-jf). On July 7, 2010, the debtor was granted a discharge pursuant to Section 727 of Title 11 of the United States Code.
On the Court's own motion, it is
ORDERED that the time for the respondents to serve and file their respective briefs is enlarged until December 22, 2010, and the respondents' respective briefs must be served and filed on or before that date.
