Application by the appellant pro se to recall and vacate a decision and order on motion of this Court dated July 17, 2009, which granted the appellant's prior motion for leave to serve and file a supplemental pro se brief on an appeal from a judgment of the Supreme Court, Kings County, rendered September 11, 2007, and to deem the prior motion withdrawn.
Upon the papers filed in support of the application and no papers having been filed in opposition or relation thereto, it is
ORDERED that the application is granted, the decision and order on motion of this Court dated July 17, 2009, which granted the appellant's motion for leave to serve and file a supplemental pro se brief on an appeal from a judgment of the Supreme Court, Kings County, rendered September 11, 2007, is recalled and vacated, and the appellant's motion for leave to file a supplemental pro se brief is deemed withdrawn.
