It is Ordered that the motion is granted only to the extent of staying the execution of the warrant of eviction through January 12, 2011. If, by said date, the appeal has been perfected and the appellant is current in the payment of use and occupancy as set by the trial court, then the latter may move for a continuation of the stay pending the perfected appeal. Otherwise, the warrant may be executed after January 12, 2011. The appellant is referred to 22 NYCRR § 640.6, regarding the time period to promptly perfect an appeal. The appeal may proceed on the original record of the trial court.
