DECISION & ORDER ON MOTION

Motion by appellant on an appeal from an order of the Civil Court of the City of New York, Queens County, entered December 4, 2009, to continue a stay granted by decision and order of this court dated March 24, 2010. Cross motion by respondent to vacate the stay.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that the motion and the cross motion are consolidated for purposes of disposition; and it is further,
ORDERED that the motion to continue the stay contained in the decision and order of this court dated March 24, 2010 is denied; and it is further,
ORDERED that the cross motion to vacate the stay is granted.
