Motion by the defendant for leave to appeal to this Court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated March 8, 2010, which affirmed an order of the City Court, City of Yonkers, Westchester County, entered March 13, 2009. Application by the plaintiff to bar the defendant from making further motions based on claims arising out of the above-entitled action.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the application is denied as academic.
