DECISION & ORDER ON MOTION

Motion by the plaintiff, inter alia, for leave to appeal to this court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated July 2, 2010, which affirmed an order of the Civil Court of the City of New York, Kings County, entered May 30, and for poor person relief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the branch of the motion which is for poor person relief is denied as academic.
