Application by the respondent on appeal from an order of the Supreme Court, Dutchess County, dated March 2, 2010, in effect, to substitute Jamie S. Young, administrator of the estate of Phillip Young, for the deceased plaintiff Phillip Young, d/b/a Affordable Paving.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, and Jamie S. Young, administrator of the estate of Phillip Young, is substituted for the deceased plaintiff Phillip Young, d/b/a Affordable Paving, and the caption is amended accordingly.
