| DECISION & ORDER ON MOTION |
Motion by Todd C. Bank for leave to appeal to this Court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated July 29, 2010, which affirmed an order of the Civil Court of the City of New York, Queens County, entered August 18, 2008, and to stay enforcement of the order dated July 29, 2010, as well as an order of the Civil Court of the City of New York, Queens County, dated October 19, 2010, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the branch of the motion which is for a stay is denied as academic.
