Appellant having moved for an extension of time to perfect the appeals taken herein from orders of the Family Court, Erie County, entered in the Office of the Clerk of said Court on October 7, 2009, and October 27, 2009,
Now, upon reading and filing the affirmation of Jeffrey M. Harrington, Esq., dated November 6, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal taken from the order entered October 7, 2009, (Appellate Division Docket No. CAF 09-02309) is dismissed on the ground that the appeal was dismissed by order of this Court entered December 7, 2009, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeals taken from the orders entered October 27, 2009, (Appellate Division Docket Nos. CAF 09-02310 and CAF 09-02311) is granted and appellant shall file the original stipulated or settled record and ten briefs on the appeals, together with proof of service, on or before December 8, 2010, and in the event of failure to so perfect the appeals are hereby dismissed without further order.
