Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Westchester County, rendered November 6, 2008, and for the assignment of new counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED the motion is denied without prejudice to the appellant notifying this Court after his assigned counsel files a brief on his behalf that he wishes to file a supplemental brief (see 22 NYCRR 670.12[g], [h]).
