It is Ordered that the defendant-appellant's motion to vacate this Court's November 27, 2009 order which dismissed the appeal is granted on condition that defendant-appellant perfect the appeal by no later than the March 2011 Term - the filing deadline is January 12, 2011. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move on five days' notice for an order vacating the appeal.
