DECISION & ORDER ON MOTION

Motion by the assigned counsel for the appellant Raheem D. D. on appeals from an order of the Family Court, Kings County, dated June 25, 2010, to be relieved and for assignment of new counsel, and to enlarge the time to perfect the appeal of Raheem D. D.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to be relieved is granted, Philip J. Devereaux, Esq., 277 Broadway, New York, New York 10007, is relieved, and said counsel is directed to turn over all papers in the action to the Clerk of the Court; and it is further,

ORDERED that on or before December 23, 2010, Philip J. Devereaux, Esq., is directed to serve his client by one of the methods specified in CPLR 2103(c), with a copy of this order and shall file proof of such service with the Clerk of this Court; and it is further,

ORDERED that the branches of the motion which are for assignment of new counsel, and to enlarge the time to perfect the appeal are denied with leave to the appellant Raheem D. D. seeking poor person relief, assignment of counsel, and an enlargement of the time to perfect his appeal on or before January 24, 2011, upon proper papers, including his affidavit setting forth the his full financial situation including all assets, both real and personal, as well as any and all sources of income and expenses.
