DECISION & ORDER ON MOTION

Appeal by Glenn Svoboda from an order of the Family Court, Suffolk County, dated May 12, 2010. By order to show cause dated October 29, 2010, the parties or their attorneys were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding for failure to perfect.

Now, on the Court's own motion, and the papers filed in response to the order to show cause, it is

ORDERED that the motion to dismiss the appeal is denied on condition that on or before January 10, 2011, the appellant submits his appendix and brief to the office of the Clerk of the Court along with a motion to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appendix; and it is further,

ORDERED that the appellant's time to perfect the appeal is enlarged until January 10, 2011.
