Motion by the appellant to recall and vacate a decision and order on motion of this Court dated July 28, 2010, which dismissed an appeal from an order of the Family Court, Queens County, dated June 8, 2009, and to reinstate the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied with leave to renew on or before January 3, 2011, upon proper papers including documentary evidence that the transcript of the proceedings has been ordered and paid for.
