On the Court's own motion, it is
ORDERED that its decision and order on motion dated November 3, 2010, in the above-entitled matter, which granted a motion by the defendant, on an appeal from a judgment of the County Court, Nassau County, rendered October 9, 2009, is amended by deleting from the preamble the words "and for leave to prosecute the appeal as a poor person, and for the assignment of counsel."
