| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to perfect an appeal from a judgment of the County Court, Nassau County, rendered April 14, 2009. By order to show cause dated November 8, 2010, the appellant was ordered to show cause before this Court, why an order should or should not be entered dismissing the appeal on the ground that it had been rendered academic by a determination of the Court of Appeals dated October 26, 2010 (see People v Brun, ___ NY3d ___, 2010 Slip Op 7580), and the appellant's motion was held in abeyance in the interim.
Upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the appellant's motion and the papers filed in relation thereto, it is
ORDERED that the motion to dismiss the appeal is denied; and it is further,
ORDERED that the appellant's motion to enlarge the time to perfect the appeal is granted to the extent that the appeal will be held in abeyance pending determination of an appeal from an order of the same court dated May 11, 2007, pending under Appellate Division Docket No. 2007-05151, and the motion is otherwise denied.
