| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from an order of the Supreme Court, Queens County, entered April 27, 2010, to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appellant's appendix. Cross motion by the respondents to strike pages 33 through 37 of the appellant's appendix on the ground that they contain matter dehors the record.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the cross motion is granted and pages 33 through 37 of the appellant's appendix are stricken; and it is further,
ORDERED that the motion is granted on condition that on or before January 7, 2011, the appellant remove pages 33 through 37 from the copies of the appellant's appendix filed with the Clerk of the Court.
